§ 10-5. Adoption of extended hours

  • Pursuant to V.T.C.A. Alcoholic Beverage Code §§ 105.03 and 105.05, the extended hours provided in those sections for the sale of alcoholic beverages between the hours of midnight and 2:00 a.m., are permitted in the city at any location where the sale of alcoholic beverages for on-premise consumption is otherwise permitted.

It is the intent of the city council that no location which would otherwise be an impermissible location for the sale of alcoholic beverages is made permissible by this section. Further, it is the intent of the city council that no seller of alcoholic beverages may sell any alcoholic beverage pursuant to this section that the seller was not otherwise entitled to sell in the absence of this section. The purpose of this section is solely to permit otherwise allowable activities during particular hours where such activities were previously not permitted.
