§ 74-300. Definitions.

  • For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:

    Curfew hours means:

    (1)

    11:00 p.m. to 6:00 a.m. any day except Friday or Saturday; and

    (2)

    12:00 midnight to 6:00 a.m. Friday and Saturday.

    Emergency means an unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes, but is not limited to, a fire, natural disaster, an automobile accident, or any situation requiring immediate action to prevent serious bodily injury or loss of life.

    Establishment means any privately-owned place of business operated for profit to which the public is invited, including, but not limited to, any place of amusement or entertainment.

    Holding location means a place designated by the police chief to which a minor taken into custody for a violation of this article will be delivered to await pick up by a parent or juvenile authorities.

    Minor means any person under 17 years of age.

    Officer means a law enforcement officer with jurisdiction to enforce this article.

    Parent means a person who is:

    (1)

    A natural or adoptive parent of a minor;

    (2)

    A court-appointed guardian of a minor;

    (3)

    At least 18 years of age and authorized by a parent or court-appointed guardian to have the care and custody of a minor.

    Public place means any street, alley, highway, sidewalk, playground, park, plaza, building, or other place used by or open to the public.

    Remain means to:

    (1)

    Linger or stay; or

    (2)

    Fail to leave premises when requested to do so by a police officer or the owner, operator, or other person in control of the premises.
