§ 74-200. Definitions.
For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
Database means the Texas Department of Public Safety's Sex Offender Database.
Day care center means a facility providing care, training, education, custody, treatment, or supervision for 13 or more children for less than 24 hours a day.
Loitering means remaining in an area under circumstances that would warrant a reasonable person to believe that the purpose or effect of that behavior is to facilitate or conceal illegal activities.
Minor means any person younger than 17 years of age.
Permanent residence means a place where a person resides for 14 or more consecutive days.
Premises means the tract of land, and include all improved and unimproved areas on the lot where a day care center, public park, public playground, residence, school, swimming pool, or video arcade facility is located.
Premises where children commonly gather means public parks, public playgrounds, private or public schools, public swimming pools, semipublic swimming pools, day care centers, libraries, churches, toy stores, and video arcade facilities.
Temporary residence means a place where a person resides for a period of 14 or more days in the aggregate during any calendar year and which is not the person's permanent address, or a place where a person routinely resides for a period of four or more consecutive or nonconsecutive days in any month and which is not the person's permanent address.
Playground and video arcade facility have the same definition as in V.T.C.A., Health and Safety Code § 481.134, as amended.
