§ 50-58. Amendments to the International Fire Code.

  • (a)

    The International Fire Code adopted in section 50-56 shall be amended by adopting:

    (b)

    Section 105.6.31 of the code is hereby amended to read as follows:

    Section 105.6.31. Open burning. An permit is required for maintaining of an open fire other than a recreational fire. Instructions, restrictions, and stipulations of the permit shall be adhered to. Open burning shall be permitted as set forth in Section 307.

    (c)

    Section 307.2 of the code is hereby amended to read as follows:

    307.2 Permit required. A permit shall be obtained from the code official, or his designee, in accordance with 105.6 prior to kindling a fire for recognized silvicultural or range or wildlife management practices, prevention or control of disease or pests, a bonfire, land clearing operations, or community tree and brush pile elimination. Permits will be issued only to the owner of the land upon which the fire is to be kindled and maintained. Applications shall only be accepted after compliance with the following:

    307.2.1 Authorization. Burning shall be allowed only as permitted by Chapter 111 of Title 30 of the Texas Administrative Code.

    306.2.2 Prohibited open burning.

    • Burning may begin no earlier than one hour after sunrise.

    • All fires must be extinguished no later than one hour before sunset.

    • All isolated residual fires and smoldering objects must be completely extinguished.

    • No electrical insulation, treated lumber, plastics, non-wooden construction or demolition materials, heavy oils, asphaltic materials, potentially explosive materials, chemical wastes, or items containing natural or synthetic rubber.

    • Open burning that will be offensive or objectionable because of smoke or odor emission when atmospheric conditions or local circumstances make such fires hazardous shall be prohibited. The fire code official is authorized to order the extinguishment by the permit holder or the fire department of open burning which creates or adds to a hazardous or objectionable situation. Examples of when permits will be denied or when fires will be ordered to be extinguished include:

    o Winds must be at least 6 miles per hour but no more than 15 miles per hour;

    o No temperature inversions.

    307.2.3 Trench burning required. Burning of trees, brush, and other plant material shall be permitted for land clearing and right-of-way clearing on the property from which the trees, brush, and other plant material is removed, provided the burning is done in a trench with forced air.

    307.2.4 Commercial burning. All commercial burning has to be approved by the Texas Commission on Environmental Quality.

    (d)

    Section 307.3 of the code is hereby amended to read as follows:

    307.3 Location. The location for open burning, except for recreational fires, shall be not less than 300 feet from any structure containing sensive [sic] receptors, and provisions shall be made to prevent the fire from spreading to within 250 feet of any structure.

    Exceptions:

    1.

    Fires in approved containers that are not less than 15 feet (4572 mm) from a structure.

    2.

    The minimum required distance from a structure shall be 25 feet (7620 mm) where the pile size is 3 feet (914 mm) or less in diameter and 2 feet (610 mm) or less in height.
