§ 46-82. Littering prohibited.

  • (a)

    It shall be unlawful for any person to throw or deposit refuse within the city except in proper receptacles. Persons placing refuse in public or private receptacles shall do so in such manner as to prevent it from being carried by the elements from the receptacle on to any street, sidewalk, or other property.

    (b)

    The owner or occupant of private property shall be responsible for maintaining private property, including the sidewalk and right-of-way in front of the property, free of refuse, and shall prevent any refuse from the premises from being carried or deposited by the elements on to any street, right-of-way, alley, sidewalk, or other property. It shall be unlawful to sweep or deposit refuse into any storm sewer, gutter, street, or alley.

    (c)

    It shall be unlawful to drive or move any vehicle containing refuse within the city unless such vehicle is so constructed, and the load is so placed, as to prevent any refuse from being blown or dropped unintentionally from the vehicle during its operation.
