§ 30-24. Theft of services and tampering.

  • (a)

    No person, whether or not a subscriber to the cable system, shall willfully, maliciously or otherwise damage or cause to be damaged any wire, cable, conduit, apparatus or equipment of the company or commit any act with intent to cause such damage.

    (b)

    No person, whether or not a subscriber to the cable system, shall tap, tamper with or otherwise connect any wire or device to a wire, cable, conduit, apparatus, appurtenance or equipment of the company with the intent to obtain a signal or impulse from the cable system without authorization from or compensation to the company or to obtain cable television or other communication service with the intent to cheat or defraud the company of any lawful charge to which it is entitled.

    (c)

    No person shall intercept or receive or assist in intercepting or receiving any communications service offered over a cable system, unless specifically authorized to do so by a cable operator or as may otherwise be specifically authorized by law. For the purpose of this subsection, the term "assist in intercepting or receiving" includes the manufacture or distribution of equipment intended by the manufacturer or distributor, as the case may be, for unauthorized reception of any communications service offered over a cable system.

    (d)

    Whomsoever shall violate this section shall upon conviction be liable for a penalty as prescribed in section 1-13. Each and every day that a violation of this section continues will be regarded as a distinct and separate offense, punishable by the fine set out in this subsection. The penalties provided in this subsection shall be enforced by appropriate proceedings instituted by the city or the company in the municipal court of the city.
