§ 26-267. Location of sexually oriented businesses.
(a)
No license for a sexually oriented business shall be granted for a location that is not within the following zone:
Beginning at a point in the south right-of-way line of the Union Pacific Railroad, the same point being the most northern corner of a 4.718 acre tract of land identified by the Anderson County Appraisal District Tax Maps as Tract 1A, Block 1216, A-33, Joseph Jordan Survey;
THENCE, in a southeasterly direction, along the western line of said Tract 1A, a distance of approximately 470 feet, to the southernmost corner of said Tract 1A, the same being in the northern right-of-way line of W. Reagan Street;
THENCE, in a northeasterly direction, along the north right-of-way line of W. Reagan Street, a distance of approximately 420 feet to a point in the north right-of-way line of W. Reagan Street;
THENCE, in a southeasterly direction, across W. Reagan Street and along the most northern boundary line of a five-acre tract of land identified by the Anderson County Appraisal District Tax Maps as Tract 6B, Block 1213, A-33, Joseph Jordan Survey, a distance of approximately 480 feet to a point in the most eastern corner of said Tract 6B;
THENCE, in a southwesterly direction, along the most southern line of said Tract 6B, continuing through a 9.82-acre tract identified as Tract 6C of Block 1213, continuing along the southernmost line of a 2.42-acre tract identified as Tract 6A of Block 1213, a distance of approximately 1,200 feet to a point in the most southern corner of said Tract 6A, same being a point in the east line of a 4.084-acre tract identified as Tract 5A, Block 1213;
THENCE, in a southerly direction, along the east line of said Tract 5A, a distance of approximately 420 feet to a point southeast corner of said Tract 5A;
THENCE, in a westerly direction, along the south line of said Tract 5A and the city limits line, a distance of approximately 335 feet, to a point in the southwest corner of said Tract 5A;
THENCE, in a northerly direction, along the most western line of said Tract 5A and the city limits line, a distance of approximately 125 feet to a point in the most western line of said Tract 5A;
THENCE, in a westerly direction, along the city limits line, a distance of approximately 240 feet to a point in the west right-of-way line of Industrial Blvd.;
THENCE, in a southerly direction, along the west right-of-way line of Industrial Blvd., a distance of approximately 1,110 feet to a point in the southeast corner of a 4.61-acre tract of land identified by the Anderson County Appraisal District Tax Maps as Tract 10B, Block 1213, A-33, Joseph Jordan Survey;
THENCE, in a westerly direction, along the south line of said Tract 10B, a distance of approximately 560 feet to a point in the southwest corner of said Tract 10B;
THENCE, in a northerly direction, along the most western line of said Tract 10B, a distance of approximately 385 feet, to a point in the northwest corner of said Tract 10B, same being in the south line of a 14.197-acre tract of land identified by the Anderson County Appraisal District Tax Maps as Tract 9, Block 1213, A-33, Joseph Jordan Survey;
THENCE, in a westerly direction, along the south line of said Tract 9, a distance of approximately 420 feet to a point in the southwest corner of said Tract 9, same being in the east right-of-way line of FM 1990;
THENCE, in a northerly direction, along the east right-of-way line of FM 1990, a distance of approximately 1,180 feet to a point in the intersections of the south right-of-way lines of FM 1990 and W. Reagan Street;
THENCE, in a northwesterly direction, across W. Reagan Street, a distance of approximately 185 feet to a point in the most western corner of a 3.18-acre tract of land identified by the Anderson County Appraisal District Tax Maps as Tract 2, Block 1216, A-33, Joseph Jordan Survey;
THENCE, in a northeasterly direction along the north lines of said Tract 2 and Tract 1A of Block 1216, a distance of approximately 1,780 feet to the point of beginning.
(b)
No license for a sexually oriented business shall be granted for a location that is within 1,000 feet of the following zoning districts: RE, R-1, R-2, R-3, R-4, R-5, MF-1, MF-2, MF-3, RP MH-1.
(c)
No license for a sexually oriented business shall be granted for a location that is within 1,500 feet of:
(1)
A church;
(2)
A public or private elementary or secondary school;
(3)
A public park;
(4)
A child care facility.
(d)
Requirements for posting an intent to locate a sexually oriented business.
(1)
The operator of a proposed sexually oriented business shall post a sign at the intended location of the business in compliance with V.T.C.A. Local Government Code, § 243.0075 as it may be amended from time to time.
(2)
The operator of a proposed sexually oriented business shall notify the chief of police of compliance with the requirements of paragraph (b)(1) of this section, by either certified mail or hand delivery. The notification must be in the form of a sworn statement indicating the location of the sign and the date it was posted and must be received by the chief of police within five days after the date of the sign's posting.
(e)
The distances in this section shall be calculated by a straight line from the property line of the tract upon which the church, school, public park, or child care facility is located to the closest construction (parking lot, structure, or other construction) on the tract upon which the sexually oriented business is located.
