§ 22-75. Violations and penalties.

Latest version.
  • (a)

    A person commits an offense if the person intentionally or unintentionally allows the direct or indirect discharge of any petroleum oil, nonbiodegradable cutting oil, mineral oil, or any fats, oils, or greases of animal or vegetable origin into the POTW in such amounts as to cause interference with the collection and treatment system, or as to cause pollutants to pass through the treatment works into the environment.

    (b)

    A person commits an violation if the person introduces, or causes, permits, or suffers the introduction of any surfactant into a grease trap; provided, however, it is an affirmative defense to an enforcement of this subsection that the use of surfactants or soaps was incidental to normal kitchen hygiene operations.

    (c)

    A generator commits an violation if the generator, through improper use, nonuse, or maintenance of a grease trap, is responsible for a blockage of a collection system line.

    (d)

    If the violation causes a blockage of a collection system line, the person may be assessed a civil penalty as follows:

    (1)

    Up to $1,000.00 for the first violation;

    (2)

    Up to $1,500.00 for a violation if the person has been assessed one civil penalty in the two-year period immediately proceeding the violation; and

    (3)

    Up to $2,000.00 for a violation if the person has been assessed more than one civil penalty in the two-year period immediately proceeding the violation.

    (e)

    If the violation does not cause a blockage of a collection system line, the person may be assessed a civil penalty as follows:

    (1)

    A written warning for the first violation;

    (2)

    Up to $1,000.00 for a violation if the person has been assessed one civil penalty in the two-year period immediately proceeding the violation; and

    (3)

    Up to $1,500.00 for a violation if the person has been assessed two civil penalties in the two-year period immediately proceeding the violation; and

    (4)

    Up to $2,000.00 for a violation if the person has been assessed more than two penalties in the two-year period immediately proceeding the violation.

    (f)

    Continuous violations will result in a $500.00 increase in civil penalty and may result in termination of service.
