§ 22-73. Permit required.

  • (a)

    Operating permit. It shall be unlawful for any person to maintain or use, or to permit or suffer the maintenance or use on any premises owned or controlled by such person in the city limits a grease trap or interceptor without securing an operating permit from the city.

    (1)

    Application. An application for an operating permit shall be submitted on a form provided by the city.

    (2)

    Existing grease traps. Prior to January 1, 2009 all owners of existing grease traps in the city shall apply for and obtain a grease trap operation permit for each grease trap located on the owner's property. The operating permit shall be for the life of the grease trap; provided, however, the following shall apply:

    a.

    The city shall not issue an operating permit for an existing grease trap that was installed in violation of any law or ordinance in effect at the time of its installation.

    b.

    An existing grease trap that was installed in accordance with applicable laws and ordinances in effect at the time of its installation is entitled to an operating permit, even if the trap does not conform with all requirements of this article. If renovations or reconstruction require the issuance of a building permit for the premises for any reason, however, the grease trap must be reconstructed or rebuilt in full conformance with this article.

    c.

    When any grease trap is removed for any purpose it shall be reconstructed or rebuilt in full conformance with this article.

    d.

    The operating permit is nontransferable.

    (3)

    New grease trap. As of the date of adoption of this article, all newly constructed grease traps in compliance with the requirements of this article shall be issued a grease trap operation permit. Issuance of the grease trap operation permit by the building official shall conclude the grease trap construction permit process and signify that the grease trap complies with the provisions of this article.

    (b)

    Fees. Each application shall be accompanied by the payment of a fee in accordance with the duly adopted schedule of fees. The applicant for, or holder of, a permit shall not be entitled to a refund of any fee paid.
